AquaSoft ® SlideShow XP five

This license agreement with limitation of liability is a binding contract ("license agreement") between you as a user in the shape of a natural or juristic person ("user") and AquaSoft ® GmbH ("AquaSoft"), regarding the above mentioned software product ("software"). This includes additional software, media and accompanying documentation, provided online or in written form.

1. Agreement on the license terms

The use of this software is only permitted if you agree with all license terms of this license agreement. Agreement is considered given if you install and/or use the software.
2. Distribution of the software

Copying or any kind of distribution of this software is prohibited without an expressly written permission by AquaSoft. If you need additional licenses, please contact AquaSoft:

3. Types of licenses

Which type of license you own you can see in your invoice that you received when you purchased the software. For all licenses applies: The software may be installed on different computers, but only one at a time, provided user and license holder of the software are identical and the software is not installed on more than one computer, covered under this license, at the same time. If you want to change the computer that is intended for the use with this software you have to uninstall the software on the old computer before you install it one the new computer.
This license applies unchanged for the installation on the new computer.

3.1 Single-user license for private use

The software may be installed by a singe person (license holder) on a single computer. The use of the software is permitted for private purpose only. The use in companies or for other commercial purposes, e.g. for the creation of (all, incl. free) advertising material, is prohibited.

3.2 Single-user license for commercial use

The software may be installed by a single person (license holder) on a single computer for commercial purposes.

3.3 Classroom license

The software may be installed on up to 15 computers in one classroom and may be used there by any number of persons for school-internal purposes. To copy the software and transfer it to other rooms and computers outside of the classroom is prohibited.

3.4 School license

The software may be installed on any number of computers in one school and may be used there by any number of persons for school-internal purposes Teachers of this school use this software at home, as long as it is guaranteed that the software is only used for non-commercial, class-concomitant purposes.
4. Backup copies

License holders have the right to create a backup copy of this software, for the sole purpose of data protection.
5. Resale, transfer of license

The software must not be resold or the license transferred to another than the registered user without the permission of AquaSoft.
6. Copyright and limitation of liability

This software is an AquaSoft production.

Although the software has been developed with the best possible care it can not be guaranteed that it is free of bugs. Therefore no guarantee is issued for that. No guarantee is issued for the functionality. No liability will be assumed for any possibly incurring losses on hard- or software, especially for data loss or loss of profit, that incur due to use or abuse of this software.
The software has been created and delivered free of viruses. Nonetheless it lies in the responsibility of the user to guarantee the protection of the licensed software from computer viruses by own means or with the help of suitable anti-virus software. AquaSoft ® assumes no liability for loss or damage.
Furthermore AquaSoft ® expressly prohibits the use of the software in applications or on systems where by human discretion malfunction of this software could result in bodily harm with or without fatal consequences. The use of this software in such an environment is not backed by the rights of this license agreement. No liability will be assumed on the part of AquaSoft ® for loss or damage due to such prohibited use.

7. Final clause

Changes to this license agreement must be in written form and must be signed by you and an agent of AquaSoft.
In cases where parts of this license agreement are or become invalid or unenforceable the validity and enforceability of the other clauses remain untouched. In such a case all parties commit themselves to replace and agree on a valid clause, that is as close as possible to the commercial purpose of this license agreement, instead of the invalid one.

The general terms and conditions of business of AquaSoft apply. They are published on www.aquasoft.de. The general terms and conditions of business of the customer do not apply.

Court of jurisdiction is Potsdam. Place of fulfillment are the production facilities of AquaSoft.
